0 Introduction

These Terms & Conditions (the “Terms”) govern your access to and use of OutoMake, including our websites, applications, tools, and AI features such as AI Game Generator, Image → Ghibli Converter, Thumbnail Generator, YouTube SEO, Social Post Generator, and Text Humanizer (collectively, the “Services”). By using the Services, you agree to these Terms.

Our Services rely on third‑party infrastructure (including Firebase Authentication/Realtime Database and cloud functions) and may evolve over time. If you do not agree to these Terms, do not use the Services.

1 Eligibility & Accounts

You must be old enough to consent to online services in your region (typically 13+, or 16+ in some jurisdictions).
You must provide accurate information, maintain the security of your account, and promptly notify us of unauthorized use.
We may suspend or terminate accounts that violate these Terms or abuse our systems.
Some features require a verified email. Unverified accounts may have limited functionality.

2 Credits, Billing & Promotions

Some features consume credits (displayed in your account). Unless stated otherwise:

Credits are deducted on successful completion of a generation/conversion action.
Credits are not legal tender, have no cash value, and are generally non‑refundable except where required by law.
Promotional credits may be time‑limited and can be changed, revoked, or expired at any time.
Prices, credit costs, and available features may change without prior notice.
We may cap usage to prevent abuse or ensure system stability (rate limits/fair use).

Tip: Your current balance appears in the header. Transaction history is available under your account.

3 Your Inputs & Outputs

Your Inputs: You retain any intellectual‑property rights you hold in content you upload, submit, or provide to the Services (e.g., prompts, text, images).
Outputs: Subject to applicable law and rights of third parties, you own the outputs generated for you. You are responsible for how you use them.
License to Operate the Service: You grant us a worldwide, non‑exclusive license to host, process, transmit, cache, and display your inputs/outputs solely to provide the Services and improve reliability (for example, to run conversions and return results to you).
Responsibility: You must ensure your inputs/outputs (and your use of them) comply with these Terms and applicable laws, including IP, privacy, and publicity rights.
Similarity Notice: AI systems can produce similar outputs for different users. Outputs are not guaranteed to be unique.

4 Acceptable Use

You will not misuse the Services or help others do so. Prohibited behavior includes:

Illegal activities; exploiting minors; harassment, hate, or incitement of violence.
Generating or distributing malware, spam, deceptive or fraudulent content, or attempting to bypass rate limits or credit systems.
Reverse engineering, scraping at scale, or interfering with the Services’ integrity or security.
Uploading content you do not have rights to (e.g., infringing images); submitting sensitive personal data without authorization.
Using outputs as professional advice (medical, legal, financial, safety‑critical) without qualified human review.

5 Feature‑Specific Notes

AI Game Generator: Generates standalone HTML/JS/CSS. You are responsible for testing, security hardening, performance, and licensing of any third‑party assets you add.
Image → Ghibli Converter: Provides a “Ghibli‑style” transformation of your image. We are not affiliated with, endorsed by, or claiming to represent Studio Ghibli. Do not imply endorsement or infringe trademark/copyright when distributing outputs.
Text & SEO tools: These can be inaccurate, incomplete, or outdated. Always review before publishing.
Storage & Links: Returned URLs may be public. Treat them as shareable links, not private storage. We do not guarantee permanent hosting; keep your own backups.

6 Privacy & Security

We use Firebase Authentication and Realtime Database to operate the Services (e.g., accounts, credits, history). For details on what we collect and how we use it, see our Privacy. You are responsible for protecting your account credentials and devices.

7 Our IP & License to You

OutoMake and all related technology, UI, and content are owned by us or our licensors. Subject to these Terms, we grant you a limited, non‑exclusive, non‑transferable license to access and use the Services for your personal or internal business purposes.

8 Third‑Party Services

We integrate third‑party providers (e.g., Firebase, cloud execution) to deliver functionality. Your use of those components may be subject to their terms. We are not responsible for third‑party websites, services, or content.

9 Changes to the Services or Terms

We may modify, suspend, or discontinue features at any time. We may update these Terms to reflect operational, legal, or regulatory changes. The “Effective” date will be updated when we post changes. Continued use constitutes acceptance.

10 Disclaimers

The Services are provided “AS IS” and “AS AVAILABLE.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. AI outputs may be inaccurate or inappropriate. Do not rely on outputs without independent verification.

11 Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, data, or goodwill, arising from or relating to your use of the Services. Our aggregate liability for any claim will not exceed the greater of (a) amounts you paid to us for the Service at issue in the 3 months before the event giving rise to the claim, or (b) USD $50.

12 Copyright & Reported Content

If you believe the Services or outputs infringe your rights, contact us with details (works claimed, location/URLs, authority to act). We may remove content, disable links, or suspend accounts in accordance with applicable law.

13 Suspension & Termination

We may suspend or terminate your access immediately for violations, suspected fraud, security risks, legal compliance, or to protect the Services. You may stop using the Services at any time. Sections that by their nature should survive termination will survive (including ownership, disclaimers, limitations of liability, and dispute provisions).

14 Governing Law & Disputes

These Terms will be governed by applicable law where you reside, unless local law requires otherwise. Before pursuing formal action, you agree to try to resolve disputes with us informally by contacting support. If we cannot resolve a dispute within 30 days, you or we may pursue permitted claims in a competent court. Nothing prevents either party from seeking urgent injunctive relief.
